Terms and Conditions

1. Overview
These Terms and Conditions (“Terms”) form the agreement between you (“you”, “the client”, “participant”) and Deeside Yoga Institute, operated by Gemma Maryan (“we”, “us”, “our”), for participation in any classes, treatments, trainings, courses, events, mentoring, digital content or online services (“Services”).
Deeside Yoga Institute is the evolving professional and educational home of work previously offered under Gem Maryan Yoga. During this transition, some services, booking systems, payment descriptors, or communications may still reference Gem Maryan Yoga.
By booking, purchasing, attending, or participating in any Service (online or in person), you agree to these Terms.
2. Services offered
We provide a range of yoga education and wellbeing services, including (but not limited to):
Private yoga sessions (online or in person)
Group classes, workshops and retreats
Yoga teacher trainings and CPD courses
Corporate yoga and wellbeing sessions
Yoga-informed wellbeing sessions and case study-based sessions
Massage/bodywork services (including Ayurvedic Yoga Massage / Deep Tissue Massage where offered)
Reiki treatments (where offered)
All Services are led by Gemma Maryan, unless clearly stated otherwise (for example guest teachers).
3. Health and safety disclaimer
Yoga, breath practices, meditation, massage/bodywork and energy work involve physical and emotional engagement.
By participating, you confirm that:
you are fit to take part and will seek appropriate medical advice where needed
you will disclose relevant medical information (injuries, conditions, pregnancy, recent surgery, dizziness/fainting, mental health concerns, or anything that may affect safe participation) before the session
you understand that you are responsible for working within your own limits
you will stop immediately if you feel pain, distress, dizziness, dissociation, or discomfort, and will inform the teacher/practitioner
Our Services support wellbeing but do not replace medical, psychological, or physiotherapy care. We do not diagnose, treat, or cure medical conditions.
4. Booking and payment
Bookings are made through our online booking system (for example Acuity Scheduling) or as otherwise agreed in writing.
Payment is due in full at the time of booking, unless a payment plan has been agreed in writing
course fees, deposits and payment plan instalments are due on the dates stated at purchase
Access to online course materials or live training spaces may be paused if payments are overdue.
5. Cancellations, rescheduling and refunds
Refunds and transfers are set out below. These Terms apply unless different written terms are stated on a specific booking page.
A) One-to-one sessions (private yoga, case study sessions, mentoring, massage, reiki)
minimum 24 hours’ notice is required to cancel or reschedule
less than 24 hours’ notice: the full fee is charged
no-shows are non-refundable
If we need to cancel due to illness or unforeseen circumstances, you will be offered a reschedule or a refund.
B) Group classes, workshops, events
cancellation more than 7 days before: full refund
cancellation within 7 days: no refund (transfer may be offered at our discretion)
if the event is cancelled by us, you will receive a full refund or credit
C) Trainings and CPD courses (online or in-person)
Cooling-off period (UK consumer rights):
You have 14 days from the date of booking to cancel for a full refund if the course has not started and you have not accessed digital materials.
After the 14-day period:
fees are non-refundable unless the training is cancelled by us
where places are limited, refunds are not offered for non-attendance
transfers may be offered at our discretion, but are not guaranteed
If digital content is accessed (including manuals, recordings, downloads, course platform entry), you acknowledge this is digital supply and refunds may no longer be available, except where required by law.
D) Early access / discounted places with testimonial agreement
If you book under a discounted or early access offer that includes a testimonial exchange:
you agree to provide a short written or video testimonial within 14 days of completing the course
testimonials will be reviewed with you before publication
you retain ownership of your image/words
nothing will be published without your approval
you may withdraw consent at any time by emailing info@gemmaryan.co.uk
(Withdrawal of consent does not alter payment terms already agreed.)
E) Corporate bookings
a 10% non-refundable deposit secures your booking
remaining balance is due 7 days before the first session date
cancellations within 7 days are non-refundable
6. Online sessions and digital content
For online delivery, you agree that:
you are responsible for creating a safe practice space (suitable floor surface, stable chair where required, adequate room to move)
you understand participation is at your own risk
you ensure a stable internet connection and suitable device
We are not liable for technical issues, connection loss, or disruptions outside our control.
Content use:
All course materials, videos, recordings, manuals and PDFs are for your personal use only. Recording, distributing, sharing logins, reproducing or reselling course content is prohibited without written permission.
7. Code of conduct
To protect all participants, you agree to:
behave respectfully and maintain confidentiality in group spaces
avoid harassment, discrimination, or inappropriate language
maintain appropriate boundaries with teachers and students
not attend sessions under the influence of alcohol or drugs
follow safety instructions during movement practices
We reserve the right to refuse participation or remove a participant from a session or course if behaviour is unsafe, disruptive, or inappropriate. Refunds are not provided in these circumstances.
8. Liability
Participation is at your own risk.
To the fullest extent permitted by law, Deeside Yoga Institute and Gemma Maryan accept no liability for injury, illness, loss, or damage arising from participation in Services (online or in-person), except where caused by negligence that cannot legally be excluded.
Nothing in these Terms limits liability where it cannot be excluded under law.
9. Intellectual property
All written, audio and visual materials (including manuals, recordings, PDFs, slides, worksheets and training resources) remain the intellectual property of Deeside Yoga Institute / Gemma Maryan.
Materials may not be copied, reproduced, shared, recorded, distributed or adapted without prior written permission.
10. Data protection
We process your personal information in line with UK GDPR and our Privacy Policy.

11. Governing law
These Terms are governed by Scottish Law. Any disputes fall under the exclusive jurisdiction of the Scottish Courts.
